TEVA annuncia sentenza favorevole sulla violazione del brevetto di Copaxone

GERUSALEMME(BUSINESS WIRE) – 4 luglio 2012 – Teva Pharmaceutical Industries Ltd. (NYSE: TEVA) ha annunciato che la Corte del distretto Sud di New York  si è espressa a favore di Teva contro Momenta Pharmaceuticals, Inc./Sandoz Inc. e Mylan Laboratories Inc./Natco Pharmaceuticals in merito alla querela per violazione del brevetto di COPAXONE®,  prodotto di Teva per il trattamento della sclerosi multipla recidivante–remittente.  Teva ha intentato causa a Momenta / Sandoz e Mylan / Natco per la violazione dei brevetti che coprono la composizione chimica di COPAXONE®, i metodi di utilizzo del prodotto e i processi per la produzione dello stesso. Questa decisione riguarda diversi brevetti, l’ultimo dei quali scade il 1° settembre 2015. Il giudice ha respinto le ragioni addotte da Momenta/Sandoz e Mylan/Natco’s  secondo le quali i brevetti di COPAXONE® non sono validi e sono inapplicabili. Inoltre il giudice ha stabilito che le versioni generiche di  COPAXONE® per  le quali Momenta / Sandoz e Mylan/Natco richiedono l’approvazione della Food and Drug Administration (FDA) violano tali brevetti. Questa sentenza dovrebbe impedire alla FDA di approvare e ai convenuti di vendere le loro presunte versioni generiche di COPAXONE® negli Stati Uniti fino a quando i brevetti  contenuti nell’“Orange Book” non scadranno il 24 maggio 2014. In base al risultato di questa sentenza, Teva ritiene inoltre che ai convenuti sarà proibita la vendita dei loro prodotti fino alla completa scadenza brevettuale del 1° settembre 2015. Inoltre qualsiasi presunta versione generica di COPAXONE®  richiederà l’approvazione della FDA prima di essere messa a disposizione del pubblico. A questo punto non è chiaro quali requisiti sarebbero necessari per l’approvazione di un presunto peptide sintetico generico.
